Missouri peach farmer files lawsuit against Monsanto

The largest peach farmer in Missouri has filed a lawsuit against Monsanto. The lawsuit was made on behalf of Bill Bader, who operates Bader Farms, and claims Monsanto has a liability over the damage the farm has experienced due to illegal pesticides used by surrounding farms.

In 2015, about 7,000 trees in Bader’s orchards were damaged, leading to a loss of $1.5 million, according to the lawsuit. This year an estimated 30,000 trees are considered a complete loss, adding up to a financial burden that has yet to be fully realized.

“Those numbers are still being estimated,” said Bev Randles of Randles & Splittgerber, a Kansas City law firm. “The losses will certainly be in the millions.”

With insurers unlikely to cover damage caused by illegal herbicide use, things do not look good for the farmer, if the lawsuit is lost, as Bader expects the losses to drive him out of the industry by 2019.
